MERCED COUNTY - Documents filed for temporary emergency orders in Merced County Courts by the mother of John Weir who was reported abducted by his father were denied earlier this year, records show.

In a document filed on April 10th, 2019 in Merced Superior Court, Sarah Weir asks for temporary emergency orders for their son. Additional documents filed in court show that the child was special needs, and required special medical care.

That medical care was to be facilitated in facilitated in Visalia, where the mother resides. Another document filed July 1st indicates that the child missed a medical treatment due to his father not returning him.

The document reads that Steven Weir “has previously deliberately withheld the child, causing him to miss medical treatment.” 

Further filed documentation suggested that both parents were in disagreement regarding visitation scheduling for holidays and vacations, and that counseling for the matter was recommended.

Additional documents filed may 17th show another filing for an emergency custody order, with the reason stating the child was removed from the marital home without consent, and his “well-being and safety are unaccounted for. His medical needs are unmet.”

On July 15th, another document outlines an injury the child received during a visitation period with his father. The document shows that during an exchange on July 6th, the mother noticed a large knot on his head and asked the father what happened.

The questioning made the father get upset, according to the document, stating that the child was fine and did not give any details as to how the child was injured.

The document also indicates that the uncle of the child, who works as a medical professional, advised the mother of what to do in case the child showed symptoms of a concussion.

Members of the community have been left wondering how the situation could have escalated, given documented circumstances.

On Saturday shortly after 11:00am, an Amber Alert was issued for John Weir after he was not returned to his mother. Monday, authorities announced the discovery of the vehicle Steven Weir, John’s father was said to be driving.

Two bodies were found near he vehicle as well, located near the Sand Flat Campgrounds along Clark Fork Road in Tuolumne County. The identity of the bodies were not released by authorities, stating that the investigation is ongoing and further details would be released once the information was available.
